These Terms of Service (“Terms”) govern your use of residential waste collection services provided by Lone Star Trash (“Company,” “we,” “our,” or “us”). By signing up for service, paying for service, or placing waste out for collection, you (“Customer,” “you,” or “your”) agree to be bound by these Terms.
1.1 Bins Provided. Lone Star Trash provides waste bins as part of its service. All bins remain the property of the Company unless purchased outright at retail value. Customers may not sell, modify, or dispose of Company-owned bins.
1.2 Bin Purchase Option. Customers may purchase bins from the Company at retail pricing if they wish to own them. Until purchased, bins must be returned in good condition upon termination of service.
2.1 Standard Household Waste Only. Weekly collection is limited to ordinary household trash.
2.2 Prohibited Items. The Company reserves the right, in its sole discretion, to refuse collection of items including but not limited to:
2.3 Right of Refusal. Lone Star Trash is not obligated to collect any materials it deems unsafe, improper, or beyond the scope of standard residential service.
3.1 Agreement to Pay. By enrolling, you agree to pay all fees associated with your selected service plan. Service is billed on a month-to-month basis.
3.2 Non-Payment Policy. If payment is not received by the due date, service will continue for up to one billing cycle at the Company’s discretion. If payment is not made within one month, service will be suspended until all outstanding balances, including back payments, are paid in full.
3.3 No Refunds. All payments are non-refundable unless otherwise determined at the sole discretion of Company ownership. For example, if you pay for three months of service but only use one month, no refund is guaranteed.
3.4 Automatic Renewal. Service automatically renews each month unless canceled in accordance with Section 8.
4.1 Access to Bins. Customers are responsible for ensuring that bins are accessible to Company vehicles on designated collection days.
4.2 Obstructions. Bins blocked by vehicles, gates, or other obstacles may not be collected, and no refund or credit will be issued.
4.3 Customer Responsibility. Customers are responsible for securing trash within bins. Lone Star Trash is not liable for trash scattered by wind, animals, or overflow due to improperly closed lids or overfilled bins.
5.1 Driveways and Surfaces. Garbage trucks are heavy vehicles. The Company is not liable for damage to driveways, curbs, landscaping, or other surfaces arising from normal service operations.
5.2 Bins. Customers are responsible for safeguarding bins from theft, vandalism, or damage while on their property. Damage beyond normal wear may result in replacement fees. The company is not responsible for any damage to bins, containers, receptacles or other items not provided by the company. If a customer chooses to use any bin or container outside of those issued by the company, the customer assumes full responsibility for any damage, wear, and/or loss that may occur during service operations.
6.1 Weather and Safety. Service may be delayed or canceled due to severe weather, road closures, or unsafe conditions.
6.2 Holidays. Service schedules may be adjusted for holidays. Notice will be provided in advance.
To the fullest extent permitted by law, Lone Star Trash shall not be liable for any indirect, incidental, or consequential damages arising from the provision or interruption of services.
8.1 Customer Cancellation. Customers may cancel service at any time by providing written notice prior to the next billing date.
8.2 Company Termination. The Company may suspend or terminate service at its sole discretion for non-payment, violation of these Terms, or unsafe conditions.
These Terms shall be governed by the laws of the State of Texas.
By signing up, paying for service, or using our service, you acknowledge that you have read, understood, and agree to these Terms of Service.
